Work Permits for Asylum Seekers—Some Good News

The new Administration has raised anxieties in immigrant and asylum seeker communities. In part, this is because of President Trump’s rhetoric (and rhetorical style) during the election. And in part, it’s because we just don’t know what to expect from a Trump Administration. Rumors have been flying: Will there be some sort of Muslim ban? Will the President repeal DACA? Or will he (and Congress) create a permanent legalization for DACA recipients? Mr. Trump will be issuing some executive orders later today banning Syrian and other refugees from coming to the U.S., and restricting visas for people from certain Middle Eastern countries. How this will all play out, we shall see.

Filling gaps is a good thing.

But amidst the uncertainty, there is some good news related to work permits—or Employment Authorization Documents (“EADs”)—for asylum seekers.

First, last fall, the government started issuing two-year EADs instead of one-year EADs to people with pending asylum cases. This was a helpful development. It saves money since applicants now only have to apply for a new card every other year. It also makes it easier to obtain and retain employment, since employers feel more confident hiring people who have a longer period of authorized employment. In addition, many states issue driver’s licenses that correspond to the dates on the EAD, so a two-year card means a two-year license. All this helps ease the wait for people seeking asylum.

Second, last week the government issued new (and long anticipated) regulations “to help prevent gaps in employment authorization”:

DHS is providing for the automatic extension of expiring EADs (and underlying employment authorization, if applicable) for up to 180 days with respect to individuals who are seeking renewal of their EADs (and, if applicable, employment authorization) based on the same employment authorization categories under which they were granted.

This means that when you file to renew your EAD, your card will be automatically extended for 180 days once you receive the receipt (it usually takes three or four weeks to get the receipt). This is an important development, since USCIS has been taking months to process EAD renewals, and people were losing their jobs and driver’s licenses while they waited for their new EADs.

The automatic EAD extensions apply to refugees, people with asylum, and people who have pending asylum or withholding of removal cases, among others. You can see the new regulations here (see page 82491, the second to last page of the PDF) and here (page 82455, footnote 98, which lists the categories of people eligible for the automatic EAD extension).

Also, remember that you can apply for a new EAD up to 120 days before the old card expires. Even with the most recent change, it is still a good idea to apply early for your new card, so you receive the replacement EAD as soon as possible.

And here’s one last tip for today. If you cannot afford to pay for the new EAD (fees recently went up), you can request a fee waiver from USCIS, which—if granted—allows you to obtain a new EAD without paying the fee. To apply for a fee waiver, use form I-912, available here.

I have written many times about the affirmative asylum backlog. It has been a real disaster for asylum seekers—especially those separated from their family members. The recent changes to the EAD process, during the waning days of the Obama Administration, have at least made one aspect of the wait easier, and for that, we can be thankful.

    I have a very worrying concern, I applied for asylum and received receipt about a month later but it’s been almost 150 days that I still receive the fingerprint notification and I’m finding it worrying. I don’t know where the problem is because the online status check isn’t recognisin my receipt number.

    • You cannot check the status of your asylum case online. However, you should have received a fingerprint notice. Contact your local asylum office and tell them that you did not get the notice.     • EADs are moving a bit slower these days, and we see them take up to 4 months. Also, it is very common for two people to file at the same time, but they get the EADs at different times. So as long as you got your receipt, none of this is a major concern. If you do not have the EAD in another month, call USCIS to inquire – you can find their phone number on their website, http://www.uscis.gov. Take care, Jason

    Thanks for all your help! It’s been amazing all the info that I’ve learned from you. You are really an activist for people who are in this very difficult situation.

    I have a question for you: I got my receipt notice on march 17th. But until this date (3+ month) I still haven’t received my Biometrics appointment. I’ve been writing to the Arlington Asylum Office and they have responded twice that I have to wait because they requested my Biometrics appointent to be sent again (For some reason they told me that they sent it the first time, but neither me or my lawyer received it). Do you think it is a good idea for me to go to the office in person? Or I will be waisting my time?

    • I do not think this is a major problem, so maybe give them a bit more time. But I do think it might work better if you go in person. They should be able to issue you a biometrics appointment while you are there (of course, they should be able to email or mail it to you as well, but it seems that this is not working).     It’s concerning to a pending asylum case.
    I read carefully about EAD. I’m the one who need it as you know, everyone need and wish alwas good things happen for him. So, it’s my first time and I’m sending my i-765 form this Wednesday 7/5. I have some questions:
    – When will I receive my acknowledgement of receipt?
    – In their website (www.uscis.gov), it’s writtten 30-90 days like 1 to 3months, but I saw in your answer you’re saying 2-4 months.
    Is it possible to have the document in exactly two months? Or steps are always required for finally reached 4 months?
    – And for finishing, about the renewal, if somebody does it prior 120 days, following your experience and knowledge when he exactly will receive it?

    • The receipt usually arrives in 3 weeks or so, the card usually takes 2 to 4 months, but lately, it seems closer to 4 months. Sometimes, it comes more quickly, but I think that is often just good luck. When you file the I-765, you can request that the case be processed more quickly. You should give them a reason with some evidence supporting that reason. This might help. Renewals also seem to take 2 to 4 months, but once you get the receipt, the old EAD is automatically extended for 180 days. Take care, Jason

  6. I apply for asylum and they sent me a receipt 8days after.And another form to go for fingerprint two weeks after i submitted the application.And have go.for fingerprint. I filed for asylum on the 22nd of may 2017.
    What else should I do now?

    • There is not much to do until 150 days after you filed, when you can file for a work permit (form I-765, available at http://www.uscis.gov). If you want, you can ask to expedite your case or short list your case (I wrote about this on March 30, 2017). Otherwise, there is not much to do but settle in and wait. Take care, Jason

    After completing form I-589 USCIS has sent me a receipt number and a case number on 02/09/2017 and 4 months later I still have not received anything yet. Should I file for a work permit or what do I do?

    I’m applicant asylum case , I open it 12/05/2016, then I got fingerprint on 12/21/2016… after this I sen request (files application about working permit) on 05/08/2017 I got receipt number , I checked and there were written that I have to get working permit till 06/14/2017… how more long I have to wait ?

    i’m an applicant of asylum. i applied work authorization one month ago. My lawyer got receipt notice but i didn’t get it yet. And i got my receipt number from copy of receipt which was received by my lawyer.
    i got this message when i was checking my case status online—

    “”Notice Was Returned To USCIS Because The Post Office Could Not Deliver It “”

    Should i do something for that ? Is there any reason for stopping the time for 90 days for work authorization ?

    How long processing time to i get Ead card !!

    • EAD cards normally take 2 to 4 months, but if you cannot get mail from USCIS, that is a problem. You can call USCIS and tell them about the problem – you can find their phone number on their website http://www.uscis.gov. You might also file a change of address form, AR-11, available at http://www.uscis.gov, on-line in the I-765 case to make sure that USCIS has your correct address. Take care, Jason

  11. Hi Jason,
    I have a quick question. My asylum case is still pending and I applied for my second EAD through asylum. I applied on 05/10/17 and I got my receipt notice on 05/16/2017. My current EAD will expire on 08/10/2017. In my receipt notice, it says eligible category is (C08) and this notice will automatically extend my current EAD if I filed on time and applied under the same category.. Can I give this receipt notice to my employer as a prove to extend my work permit????? Thank you, Nousaiba

    I applied for my asylum from CA. Awaiting EAD now.
    We didn’t actually stay in CA for all this while.We stayed with several families at several states as we did not know what else to do as there was money shortage.I wanted to ask you if it ok for us to apply our social security card, license etc from the place that we get a new job in.Not confirmed yet.And then change the address later with the USCIS when we finalize our job and place to stay and get a new address.     • This is a problem for many people. You are supposed to update your address, but what to do if you do not have an address? Once you have a “permanent” address, you should update as soon as possible (you are supposed to do that within 10 days). It sounds like that is more-or-less what you are trying to do, and as long as the USCIS does not think you are trying to hide your address or use an address that is not really yours, you should be alright.     • Unless you have some other way to get a work permit or work visa, I know of nothing you can do – Asylum applicants are required by the regulations to wait 150 days before they can apply for an EAD, and it takes another 2 to 4 months to actually get the EAD. Prior to that time, they are not allowed to work legally (unless they have some other visa or work permit from another source). Perhaps your employer would allow you to do an unpaid internship until you have the EAD? Some employers are flexible. Good luck, Jason

        • If you do not leave the US, you may be able to convert while asylum is pending. It is more likely to succeed for an H1b than a J. If you want to do that, talk to a lawyer first to make sure that you have a good chance for success; it is normally not really worthwhile to change to another visa while your asylum is pending, and the change could be denied, which would waste money.     I have a question about Job Authorization. My card will be expired on August 25, 2017. Can I apply for renew it before that time? How can I request to waive the application fee? I have documents of Essential plane insurance that means I have low income. They waived my application fee last year based on my insurance documents. I had interview for my case two months ago, however I have not gotten the results so far. How can I renew my card very soon? What should I do to start renewal process?

    Well….I have been waiting since Mar 18 that my EAD was denied by USCIS and d same day I got a reopen notice from USCIS….summary…my EAD was approved March 17,2017…denied Mar 18,2017..reopen and reconsidered March 18,2017…after uscis found out that there was no reason denying it as my lawyers actually waited 150days before they applied for my EAD because that was USCIS initial reason for denying my EAD…I have waited 3 months now and no response from them…please what can I do…am so fraustrated….or I should i just say fucking fraustrated. …am so messed up at this point….please help with ur advice..Thank u

      • Hi Jason…thank u for ur reponse again….I was told by my lawyers that USCIS stated that I can not expidite my case…and they asked me to be patient and wait…then I asked them what if it takes more that 3years to get a reply..should I still wait till then ?and that replied YES! At this point they asked me what I wanted dem to do for me…and I requested they send another EAD application .they also said they wrote a letter to the Texas office that reopen my case….my question is..I hope me sending another EAD application is not gonna be a problem???since I can’t expidite and I still haven’t gotten a response from them???I should have used USCIS Ombudsman link but like u said it takes longer time…am as confused as my lawyers as I only hope God help me out and grant me more patience to get through all this….please Jason as a lawyer…what would u have advice I do again???I await ur response…God bless U

  18. Hi,
    I did have an EAD twice before when I was a student last year. This year I’m a pending asylum seeker. I already filed for my EAD 150 days. It’s been 180 days already since June 17th. Will I be waiting for more than a month like anyone who hadn’t had a work permit before? Or will mine be processed faster?

  19. Hey so I received I I-589 receipt but lost it. Is there a way I can request for a new one so that I could apply for my work permit? It’s kinda stressful for me coz I’ve called the call center lots of times but they won’t help.any advice?

    • You can go directly to the local asylum office and ask for a receipt – you can also try to contact them by email and ask. You can find their contact info if you follow the link at right called Asylum Office Locator. If that does not work, you can file a Freedom of Information Act request (form G-639, available at http://www.uscis.gov) to get a copy of your entire file, including the receipt. This approach will take a few months, so it is better if you can just get it from the asylum office. Take care, Jason

Hello.. applied for asylum last year and after 155 days I sent my I-765 and it’s been 35 days since I got my receipt notice and my status still says: ” my case was received “.my question is:should I keep waiting or should I call the number on the receipt a to see what’s going on ?knowing that this is my first time applying for ead so it was supposed to be waiting for 30 days

    • We have not seen first time EADs take 30 days. Usually, they take 2 to 4 months, so I think you will get it in another month or two (or three). Take care, Jason

    I have two questions regarding my asylum case.

    1. My EAD receipt states that they received my application as of 02/09/2017. As it is almost one month before I have to apply for the EAD card, should I start filling out the form now and have my lawyer mail it out postmarked exactly on 07/09/2017(150 days from receipt date)?
    2. I have a SSN from my F1 visa, would I be able to use that SSN when I get my EAD card to work, or should I apply for another SSN?

    • 1 – Maybe you mean your asylum receipt is dated 2-9-17? If so, you have to wait the 150 days and then you can submit the I-765 form for the EAD. It does not take long to prepare that form and supporting documents, but I suppose there is no harm in doing it early. 2 – I think you can use the same SSN in combination with your EAD. You may need to contact the SS office to get a new card, but you should be able to keep the same number. Take care, Jason

        There are two dates on the document. The asylum receipt is dated 2/23/17. But the receipt text states the following: “Your complete form I-589 asylum application was received and is pending as of 2/09/17”

        Does the asylum EAD clock start from 2/09/17 or 2/23/17?

    • If you fear return to your country due to a political issue, you can apply for asylum. You must wait 150 days after you apply, and then you can apply for an EAD, which takes another 2 to 4 months (usually). Take care, Jason

    I hope you are doing well. I just received my EAD card but the card shows country of birth as “unknown.” So per instruction on my approval notice, I sent them a letter explaining the mistake with supporting documents for the correct information. I was wondering how long does it for them to revise the card and reissue a new card? In the meantime, can I change my address or does that delay matters even further? Thank you very much for all your assistance.

    • I do not know how long it takes, but I have heard about one such case where it took 3 or 4 months, so maybe it will be about that long. I suppose you can change your address and it should not affect anything (you can do that on-line – form AR-11, available at http://www.uscis.gov), but if you can wait until you get the new card, that may avoid the chance of a mailing error.         • It is hard to tell, but it seems that everything with USCIS is slowing down. Green card cases, work permits, etc. seem to be going more slowly. It is hard know, since we only have a few cases, but that is just my impression. Time will tell. Take care, Jason

    My I 94 is expired and I entered with a B2 visa now I have a pending Asylum case and I’m applying for EAD, What answer should I put for Question 15 in the I 765 form. Also please advise if no one prepared the form for my self should I leave that part blank or put N/A?

    My wife is the main Applicant of a pending Asylum case. I’m included with her in the same file. We almost completed the 150 days to get the EADs. But until now we have not received the fingerprints notice. Is that delay in receiving notice can cause any denial for the EADs. Also please advise what specific documents are required for us (Husband and children) in addition to the I94 and passport copies as only my wife name is mentioned on the Asylum case Receipt?

    • I do not know whether it will matter that you did not get fingerprinted, but I think you should contact the local asylum office and tell them that you never got the fingerprint notice. As for the EAD, you have to look at the instructions to the form I-765, as I do not know your case and sometimes different items are needed (see http://www.uscis.gov for the form and instructions).     • You would have to check with the DMV. In some states you can; in most states, you need the work permit first. Also, even without the state ID, you should be able to rent a place to live and open a bank account. Take care, Jason

  29. My boyfriend applied for Asylum in 2014 he has work permit and SSN. we are about to get married. I would like to know if he can add me to his process and if I will be able to receive a work permit like him? Actually I am F-1 student.

    • Once you are legally married, he can add you to the case and you can get the work permit once you are added. He can contact the asylum office to ask how to add you to the case.     • A person who files for affirmative asylum does not have to pay for the first employment authorization document. So if you filed the I-589 and waited 150 days, the first EAD should be free. Take care, Jason

    • If she is a “dependent” in your asylum case, she is part of the case and gets an EAD and (hopefully) asylum at the same time as you. A “dependent” is someone who signed page 9 of the I-589, attached her photo to that page, and submitted it with your case. Also, normally, you would have submitted a copy of her passport and the marriage certificate. If you received a fingerprint notice for you and one for her, you should both be fine. Take care, Jason

Hello Jason , we filled for asylum 3years ago , after the interview we were given a date to return for our results ,on condition we bring all the required document , all document were completed expect for my nephew’s birth certificate who is a minor . We tried getting it but didn’t meet the two weeks deadline that put our case to pending I guess . We didn’t hear any word from anyone . We applied for our Work Authourization and was given , after the one year expired , we reapplied again and was given two years , Dec last year , my late brother’s wife and her four kids were all granted asylum but my case is still pending . Any idea on what’s going on ? Now I just got married and my husband has a B1B2 visa , can he fill under me ? Please your feed back will help a lot because I’m confused .

    • Maybe that is the reason for the delay, but there are lots of reasons and many of those are beyond your control. You husband can file independently if he has a case for asylum, or you should be able to add him to your case (which would allow him to get a work permit sooner).     I have a similar question to Asma. My EAD expired on February. I applied for renewal this week. So when I get my reciept will I be eligible to get employed or the regulation only applies dor those who are currently employed?

    • If the EAD is based on asylum pending, your receipt will automatically extend the old EAD for 180 days. During this time (and once you get the new EAD), you can legally work. Whether you are currently employed is not relevant to this. Take care, Jason

            I would appreciate if you could answer my question. I had filed for an asylum about 2 weeks ago and got mail with fingerprinting location. It is New Orleans and says that I should get it done between 5/28-6/11 dates from Mon through Friday. First question, do I have to do any other specific appointment for fingerprinting or do I just walk in within these dates? If there is a need for an appointment, do I schedule it through infopass uscis website or is there any other sources? If no scheduling needed, do I just walk in? Please let me know.           • You should just walk in before 6/11 during their business hours. Bring the letter and your photo ID. We have seen a few times where people were given an appointment and told to come back another day, but you cannot schedule an appointment in advance. Take care, Jason

            Appointment before going for finger printing
            To avoid delay i would go on first day of the timeline given on the letter to avoid employement authourisation delay.
            It is normally stated on the letter.
            Hence go asap.
            Just walk in they are very helpful at the venue

    • 1 – Maybe, but I do not know about that. Many people get health insurance through a job. 2 – If you fail to pay, it could be a negative factor in your case, though usually no one ever asks about this (but once in a while, they do ask). Take care, Jason

  39. Hello, Jason! I’m an asylee and I’ve been in the USA for 1yr and 10months under the asylum category. I applied for the green card almost 8months ago and still haven’t heard from them. My EAD is about to expire prior to July 20th, 2017. I was wondering how I can apply for the EAD renewal. And also do I have to pay a renewal fee? Thank you so much!

    • You do have to pay a renewal fee if you apply based on the asylum status (unless it is your first EAD from asylum approved). You can apply for a fee waiver if you want, using form I-907, available at http://www.uscis.gov. If you already paid for the green card (the I-485), you should be able to get an EAD based on the pending green card application by using the I-485 receipt in lieu of paying the fee. Sometimes, this does not work, but it should work (but only for the first EAD based on green card pending). Take care, Jason

    • If you are eligible to adjust status, you can get your green card through the marriage and then close your asylum case. You do not have to do that – you can continue your asylum case if you prefer, and the asylum office will give you a decision. Take care, Jason

        • It’s up to you – look at the forms (starting with the I-130 and I-485, but there a number of others that go with those forms) and see if you want to do it without a lawyer. A lawyer makes it easier, but you have to pay for that service. Good luck, Jason

        i also didnt get a call for biometric for 3 month n went to enquire to sanfranssisco asylum office n dey send it immediately and i received mail after 10 days of enquiring.
        just check in google ur nearest office n dey have particular day n time for walk in enquiry.

          • If she is a “dependent” in your asylum case, she is part of the case and gets an EAD and (hopefully) asylum at the same time as you. A “dependent” is someone who signed page 9 of the I-589, attached her photo to that page, and submitted it with your case. Also, normally, you would have submitted a copy of her passport and the marriage certificate. If you received a fingerprint notice for you and one for her, you should both be fine. Take care, Jason

    • Once you are legally married, he should be able to add you to his case and you should be able to get the work permit at the same time as him.         • If you gave your true name and info on the asylum application and EAD, I doubt there is any problem applying for the job. If you lied on the asylum application, it might show up on the airport background check (and it might cause real problems for your asylum case too – so you hopefully you did not do that).     I applied for an asylum and have a ssn number from my previous visas. May I work on this ssn number until I get an EAD, I know that it takes 150 days until I am able to apply for it.

    • Probably not, unless you have permission to work aside from the asylum-pending EAD. Once you have the EAD, you can work legally. Take care, Jason
