    Thank you for the work & patience you have for us.
    I have file my renewal for EAD! I am the main applicant, my spouse is included on my pending asylum case. We have filed together for to cards, & paid separately as instructed. We got received respond letter back from uscis, then a transfer letter for both at the same time in the mail. In 17th April my husband got approved notice, & today when we check the status online, it shows that his card has been mailed, to him. However in my status it still remain that my case was transfer to a new place. I dont understand it, i am the applicant, does this normally happen? I am sorry but i keep asking you questions. Its just that i worry alot, & i have bad dreams of my past that keeps stressing me out.

    • Waiting times vary. Usually it takes between 2 and 4 months. If you are worried, call USCIS – you can find the number at http://www.uscis.govhttp://www.uscis.gov, but my guess is that it is a normal delay and you will get the card soon. Take care, Jason

    Please I need your advice and I don’t know if I should contact you directly because I am so disturbed as to the plight of my children and wife.
    My asylum case is pending but I wanted to apply for the Advance Parole document to travel to a third country where I can hospitalize my sick wife and children.
    But my problem is can I be guaranteed reentry into the U.S.?
    With a pending asylum case, what are the conditions I need to meet in order to reenter the U.S.?
    Please help me with advice, even if I need to meet you personally.
    I am so afraid to loose my children who are sick..

    • You can apply for AP using form I-131, available at http://www.uscis.gov. If you have AP, you should be able to go to a third country and then return to the US. If you have a criminal record, or if your case is with an immigration judge (or was ever with an immigration judge), then using AP can be a problem. Otherwise, you should be able to re-enter the US – that is the whole point of AP. Take care, Jason

    I have a question sir.
    Actually, my asylum case is pending and I included my wife and children who are still back in my home country.
    The issue is that since my wife is the leader of their Christian women ministry back at home, a religious organization or church is planning to invite her to attend a conference for Christian women leaders in the U.S.for one week.
    Can my asylum application affect her non immigrant visa in any way?

    • It is usually more difficult for family members of asylum seekers to get a visa. This is especially true for spouses, so she may have a hard time getting a visa. Anyway, she can try. Take care, Jason

    You are doing a great job helping us.
    I have a question:
    We wanna move in Sacramento,CA and of course our case will move too in San Francisco Asylum office.
    My question is if we gonna save our position in “line”? Right know we are in Arlington. I applied for asylum in April 2015. What if SF office gona be looking at cases after may 2015(august,september) what’s gonna happen with our case? Where we gonna be?

  8. Dear Jason,
    My wife and child are in a third country and I am an asylum seeker. I plan to bring them to the USA once I am granted asylum. So my question is:
    Is there anything we can do to prepare for the process of family reunification so that it might help to shorten the time Z process takes? Is there any paper work or any documents that we can make ready so that once the process is started we can have them ready????

    • You can look at the form I-730 (available at http://www.uscis.gov – the form that you will file to bring them to the US) and see what documents are needed, and prepare them so you are ready in the event that the asylum case is granted. Take care, Jason

    How are you? Hope u r well.
    1. My wife and child want to apply for a USA tourist visa at the consulate in my home town and the embassy knows I am in the USA. Will the American embassy back home know that I have applied for asylum? I submitted the I 589 a month ago and did my finger prints. And if they find out that I applied for asylum, will they deny my spouse and child the non immigrant visas?
    2. I am still in legal status as the I 94 duration of stay has not expired, so if I withdraw my asylum application and go back, will I be denied another non immigrant business or tourist visa?
    3. Which one do you think is a more convincing case for expediting an asylum case? My health problems as an applicant(which are not that serious) or my daughter and wife health problems who are back home and my daughter’s illness is chronic….

    • 1 – I think they will know, and it likely make it more difficult for them to get touristy visas. I think your spouse should not try to cover that up, because if the embassy realizes she lied, it will certainly not issue a visa. They may be better off with a different type of visa that is not affected by your asylum – an H1b or an L, if they qualify for that. 2 – You can do that, though your asylum application may make it more difficult for you to get a new visa in the future. 3 – I think you can mention both. If your problems are not that serious, do not make that the main focus of your request and focus on your family; but you can mention your issues as well. Take care, Jason

  10. Hey Jason or anyone who has applied or has gotten one before. Back story, I’m a LPR through Asylum, applied for my first Refugee Travel Document which was finally approved after 9 months. I got the I-797 in the mail and it says I was approved for reentry permit; I had applied for RTD. My question is, aren’t these two different document? Is the what it will always say even though it is an actual RTD? Am I just paranoid or did they make a mistake?

    • Maybe I do not understand the question, but the I-797 is just a receipt; it cannot be used for travel. The RTD is the document you use to travel and re-enter the US. Take care, Jason

    • Usually dependents can travel home, but you should talk to a lawyer before they do that. If the return trip causes the US government to think that your case was false, then you (or they) could have a problem. Typically, if you claimed that your whole family is in danger, and then they return home, it could be a problem. But if the only one in danger is you, it is probably ok for them to travel back. Again, talk to a lawyer before they go back to go over the specifics of the case and be sure. Take care, Jason

    I applied for asylum before 2 months. I am planning to ask expediting for my case. My wife and one daughter are outside USA. My wife is always under the followup of the security officials because of my political opinion and membership of opposition party. she is living in fear. How and what documents are needed to apply for expeding. I already contacted the local asylum office and they told me, i can ask. i need your recommendation.

    • Whatever evidence you can get of the problem – a letter from your wife. Letters from other people who know about the problem. Of course, your case must be complete and all documents submitted at the time you ask to expedite. Good luck, Jason

    I missed my asylum interview because I didn’t receive the asylum interview letter. I always have problems with my local post office. This not first time that I’m missing my mail letters or packages. The USCIS office is requesting “good reason” to reschedule my interview. So tomorrow I’m going to visit the office and explain the situation. I hope that they will reschedule my interview. Mr. Jason how do you think how long do I have to wait for my rescheduled interview. Now I’m very disappointed as I’ve waiting for this interview for almost 3 years. Thanks

    • Usually, rescheduled interviews are given high priority, so if they agree to that, it will only, hopefully, take a few weeks or months. Maybe ask them if they can give you the interview notice that day (or if you can pick it up in-person at a later date) in order to avoid having to get it by mail. Or, maybe you can get yourself a Post Office Box (PO Box), which might be more reliable (though of course, you will need to go to the post office and check it every day). Or maybe use a friend’s address. Good luck, Jason

  14. Dear Mr. Dzubow

    I want ask the question about possibility of protection grant in USA. I am not a lawyer, I do not know too mach about specific lawyer`s language. Therefore it will be difficult to describe my cases, because it is strongly related with terms and sentences from law branch. However I try to give the widest background of my situation, and my question about asylum and/or subsidiary protection.
    According to the Dublin Regulation (Act?) A person deemed in need of protection is one who:
    is a victim of corporal punishment or other inhumane or degrading treatment.
    I my case both conditions are met.

    “ corporal punishment“
    In November 2016 I was attacked by representatives of municipal authorities, and I was beaten and strangled. As a result of this, I have health problems until now. In prosecutor’s office

    I report an offence (the offence notification ) and also was secured the video from urban monitoring, where is brightly one can see tha I am under attack. Also one person agree to be witness of this occurence, and testify. However against the evidences the prosecutor write in his decision: “ there was not any crime, by representatives of municipal authorities are not guilty. “ Also this persecutor had lied, in his documents that on the video there is no act of violence. I have the copy of this video where this attack could be clearly seen. The reason of this behavior of prosecutor was to hide the crime caused by other members (as himself) of other authorities.
    According to the law (i. e. Criminal Code/Penal Code, and other Acts) I had right to bring the accusation to the court. And i did it, and also I attached the medical documentation, that this attack (in November) caused the damage to my health. However the judge said: there was no crime, the prosecutor said true. According to polish law it was the last instance for me. And also judge was extremely biased, because he want to not allow to bring to the light, that other members of authorities committed an offence (just “swept it under the carpet“). And therefore the persecutors, and judges allows for using the corporal punishment.
    “ degrading treatment“
    Other court = other judge and other persecutors behaves in this same way when i was reported an offence related with some public university, which stole the patent (engineering issues) fro me. Because I was PH.D student at some technical university and author I one solution. According to the regulations of “Industrial Property Law“ (an Act from polish regulations) I should be an owner of this solutions. However this university takes all documentations and they reported this to the Patent Office of the Republic of Poland as their property. After a few moths I write the paper to this university with demanding the return of my properties. This university respond (official paper/writing), that indeed I am an author, and I should be owner of this patent.
    All of this documentation I putted together with my report of offence in prosecutor`s office. But also in this case law`s institutions says: “ there was no crime, members of authorities (public university didn`t commit an offence/crime. And the same they allows themselves to treat citizens in degrading way and also into the humiliating way.
    Therefore i want repeat my question, could I start application for protection, due to described above reasons?

    • I cannot speak to other countries, but if you are in the US, you would need to show that you have a well-founded fear of persecution if you return to your country. If your previous problem was considered “persecution” (and it sounds like it probably was), then you should qualify for asylum as long as the persecution was “on account of” your race, religion, political opinion, nationality or particular social group. From your description, I cannot tell why the authorities attacked you, and unless the attack was on account of one of these protected grounds, you would not qualify for asylum. You might still qualify for other relied, like Torture Convention relief. I recommend that you talk to a lawyer about the specifics of your case and then the lawyer can better evaluate the likelihood of success. Take care, Jason

    I have a question if some one withdraw his asylum case and go back to his country, what stamp will be made by immigration officer on the passport during his traveling back to his country either they stamp his passport with word Deport or some thing else, moreover in future if he wants to travel to some other country is there any possibility of any trouble for him because of stamp marked by US ?

    • I do not think there is any particular stamp that you receive if you leave the US while your asylum case is pending. I do recommend that you contact the asylum office and tell them that you are leaving, and then ask them to cancel your case. If you do that, it can make it easier for you to return in the future.     finally my EAD online status (California) changed with “New Card Is Being Produced” so I call customer service, they said its produce yet not mail to you, it will take more about 30/60 days to mail you,

    more over I also inform that for my EAD application, I had changed my new address online on 04/05/2017, they said it will take at least 30 days to changed new address, so I ask them they will send my card on new address, they said might be, now I am worried that, if card return back to them so again it will take long time to get back,

    • I am not sure there is anything to tell you. You already changed your address and the card is being produced. The address change online should work, and hopefully you will receive your card at the new address soon. Take care, Jason

  17. hi jason, i applied for an asylum 2013, and i have my biometrics but after that my case still pending and i got my working permit then and keep on renewing it since then, now i just got my noticed for interview this coming april 28, i got married and had a baby last year but my husband just petition me, we have’nt got anything from his petition… what should i do now ?thanks

    • Inform them about the relationship at your interview. Bring your marriage certificate and birth certificate of your child. If you want to be extra good, complete pages 2 and 3 of the asylum form and bring them with you to the interview, so you can give them to the officer when they ask about your spouse and child. If you lose the case, you can probably get your green card based on the marriage, but I think you probably have to go through with the case at this point (and if you do not show up at the interview, it could cause worse problems, so make sure to attend).     I’m on pending asylum and i have applied from new york. Can i do a contract IT job out side new york? Because it is the nature of my career as i have to move from city to city or state to state depending on projects. I can prove this during my interview by a letter from my employer. And as long as im filing my tax return from new york, will there be any problem ?

    • There is a way to get criminal records for the US from the FBI. I think you can learn about it on the FBI website. It is usually also possible to get a document from the local police where you live – you would need to contact them directly to get the record (or the document stating that you have no record).     I hope you’re doing well. I have been reading questions and answers on this forum for a quite while. I have always found answers for my questions tho. Now I really do have a question and hopefully there is a positive answer. I have a pending asylum status since July 2015, but I wanted to get back to school and most of the schools I try to go to require a status. They wouldn’t give in state tuition because of my status even though I’ve lived in Maryland for over 2 years. I know my chances are slim here but thought you or someone else might have ecountered a situation like mine. If you have any info please share with me. Thank you in advace for the amazing effort you take to help.

    • My experience is that people with pending asylum cases cannot get in-state tuition. However, they can attend school using the EAD. You may want to ask the school about possibilities for in-state tuition (just to be sure) or about scholarships/fellowships, as maybe there is money available to help pay the tuition.     • If your case is with the Judge, then you should send one copy to the Judge and one to the DHS/ICE attorney’s office. You can also send a copy of the I-589 and other documents (per the instructions) to the office to get your fingerprints.       This will also give you a receipt, which you can keep with you in case you are ever questioned. For now, you can carry with you a copy of the court order with your next court date. Take care, Jason

    • I do not know why you would mail one to ICE, but if you have sent it, you should be relatively safe from any trouble. You should get the receipt in a few weeks, and you can keep that with you as evidence of your status. Take care, Jason

    Now I have Q is that, I got my asylum acknowledgement receipt from 450, golden gate ave, po box 36096, -4th flr, SFo, CA-94102, and if I try to search asylum office locater as per my ZIP code (please note my Zip code is same for old and new address), its shows the address SFO asylum office 75 Hawthorne Street, 7th Floor San Francisco, CA 94105, shall I send the AR-11 form as per location locater and also CC to office which I got the acknowledgement receipt, kindly advise ,

    So yesterday I called USCIS and the agent told me on phone that the processing of my EAD renewal application will start as Day 1 after receiving the requested initial evidence, which is astonishing as my application was received by USCIS in Nov, 2016. I remember that the notice for initial evidence said that the processing will stop until the initial evidence is received and will then resume after the evidence is received. But the agent’s point was that everything will start from point 0. Can you please clarify this confusion?

    • I am not sure that the agent knows what he is talking about (they sometimes do not). Typically, when there is a request for evidence on any type of case, the waiting time is less after we respond than the normal waiting time for a case start-to-finish. Often, in fact, we receive a decision not long after we respond to an RFE. On the other hand, it is difficult to know what goes on internally at USCIS, and waiting times are pretty unpredictable. Hopefully, you will get a response soon, but there is not much you can do, and so you will just have to wait and see. If there is no news in 3 or 4 weeks, call them again to inquire.     • I mean there is difference between “resume” and “start”.

      • They are missing info. They won’t work on your application unless you send them what they’re missing. Usually they send you a letter telling you what’s missing, or you could call them and ask what they need. In general, they need a signed application, two passport style pictures, check for fees, a copy of your old EAD (if any), a copy of your receipt for asylum request, and a copy of a government issued ID. Sometimes they require more documents.

          • When your application is missing info, it’s not put on hold. Instead, it is put into a missing info pile. When you satisfy their request for info, your application goes back into a pile where any new immigration officer can pick it and work on it. That’s why its “start” and not “resume.”

  26. Jason I think my B1/B2 visa is haunting me, and now I’m scared I might be on the wrong side of the law. I landed in the U.S. in August 2015 with a B1/B2 visa when I was 18. The following month I applied for asylum. On 15 December 2016 I was interviewed and on 17 January 2017 I was granted asylum. I also work at O’Hare airport in Chicago for several airlines. Working at O’Hare, you require an airport badge, and to get that badge you must be cleared by both Customs and border protection-CBP (because you’ll have access to the immigration areas of the airport) and by the city of Chicago (they run FBI checks to make sure you’re harmless). While renewing my badge for the third time since I got this job, I passed my security checks by the city, but CBP failed me. The CBP officer claimed I “lied to the State department” by coming to the U.S. with a tourist visa, and then applying for asylum. I told him I never lied to anyone about anything, then he started yelling at me as he got closer while doing a lot of hand gestures. I thought he was going to hurt me. Then he said “you’r hologram is denied. Leave my office, you’re not welcome here.” I told him “how come you guys gave me a hologram the first two times while I was a pending asylee, but now when I won asylum you’re doing this?” He yelled: “those were a mistake, now get out!” The entire point of my story: Am I at fault? Is what he did lawful? If I am at fault, how can I fix it?

    This is how my story ended (this part is only for gossip):
    I was really afraid he was going to hurt me. I couldn’t even breath. The first thing I thought about was running to the police to tell on him, but then I decided to tell my boss first. I ran to my boss’s office which requires me to swipe my badge. The door denied me access. The as*hole officer instantly deactivated my badge! At that point I started to cry. I called my boss and she let me in. I told her the entire story while jumping all over the office. She then told me to give her my badge so that she can solve the issue with immigration. I refused. I thought she was going to piss CBP off by confronting them, thus they’ll deport me (especially considering the fact that she is Italian, and that she’s always looking forward to picking a fight!) I was so afraid I wouldn’t give in! Then she finally managed to take it from me and she disappeared. 20 Min later she comes back with the CBP watchdog at O’Hare, the head of CBP at O’Hare, and also another CBP officer. The officers tell me there is nothing to be afraid of, and that they just want to take a look at my documents. I gave them everything I had (my social, my EAD and my state ID.) They take a moment to examine them, then they compared it to research they did on me (they were very secretive and held documents they already had about me very close to their face so that no one sees.) Then all officers started to stare at each other and were confused as to why I was denied, so they ask me to tell them the entire story. After that, they asked me to discribe the officer. I described him as a big black scary guy who might pass as a latino. All officers say at the same name at the same time “its G*****! God damn it G*****!” The head CBP officer apologized and told me he was going to reinstate my badge, and that I could go in the next day and renew it as normal because he was was going to “take care of it.” As he walked out, he told my boss out loud “put this kid back to work” with a before saying it.

    The next day, I went back to the CBP office to finalize my badging application. The same officer who yelled at me was there. He snatched my application from my hand and told me “give me your application before you become sad again and go tell on us.” He went ahead and gave me a homeland security stamp on it. Do you now how he handed me my application? He literally threw it on the floor in front of me in a very childish way, then he stormed out of the office.

    • You cannot change your address for asylum cases on-line (though can for EAD cases). You have to give the AR-11 directly to the asylum office by mail, email or in person.     • He can try to return. Some types of visas, like the H1b and the L, may not be affected by the prior asylum case. Others, like the B and the F, may be, and it might be more difficult to get such a visa in the future. Take care, Jason

I have filled in my application and ive given a brief description for my reasons as to why im seeking assylum would that be enough or do i need any other info. Aswell i dont have funds for a lawyer and not to sure on how to go about a “free” or cheap lawyer could you please assist.

And also how long does it take it will take 3 or 4 months ? and also i dnt work chick i work cush still i didnt pay my income tax if cant pay all my tax in one time and i divided for 2 quater does it effect for my work permit and if i apply for work permit and i get the recied and i didnt get my work till 3 or 4 months can i work with that receied number or no ?     • You should talk to an accountant about the taxes, but your failure to pay should not affect whether you can get a new EAD. Take care, Jason

  34. Hi jason ! my work permit expire after 3 months how much will be fee it is the same fee or i should pay more before it was 380 and now i see it almost 495. Im confiouse now if i pay 495 i should send all that to homland security or ather place too . Before i sent 380 to homeland security and now i see it is 2 part 410 and plus 85 for biometric service fee . I should make all the money for homeland security or other place too please i need ur help thanks .

    I applied for asylum and received receipt in January.However it has taken so long to be called for biometrics. Do you think that a 1 month wait period would be any cause of alarm and should i contact my local office to find out the status?Thank you.

  37. Hi Jason,
    I was wondering if I can apply for asylum and fill a petition for EB2 employment based immigration at the same time. I have a chance to get GC through EB2 national waiver category, but once my petition refused I would be out of status. So I intent to apply for asylum first then EB2. If I cannot get approval under EB2, my asylum application will stay.
    Would you please advise me if this is possible and this is a wise thing to do.

    • You should talk to a lawyer about the specifics of the EB2, since I do not know your case, I cannot comment on your eligibility. However, if you are eligible, an EB2 application is not incompatible with an asylum application. In other words, there is no reason why a person cannot do both, assuming he or she is eligible for both. Take care, Jason

  38. Hi Jason, I’m wondering what options I have now. I applied for a RTD last August, paid the fee and did fingerprint and everything. I’m a GC holder through Asylum. My case is still pending and I’ve seen thousands of people who applied after me and got through. Now I have done the whole ombudsman, level 2 reps and uscis, emails and the most I got was that my case is being processed. What other option do I have?

    • You could contact the Congressional representative. Sometimes, in cases like this, Congress can help. Also, if you have not already done it, you can make an Info Pass appointment at http://www.uscis.gov and go in person to ask USCIS about the RTD. But usually the Ombudsman is done after the Info Pass, so I do not know whether that would be worthwhile at this point. It is strange that the delay would be so long. Take care, Jason

  39. Hi jason… I have my first MHT hearing in december 2017 almost after 9 months so before that hearing do u think i can apply for EAD? And Also i have my fiance Here she Is A LPR ..and we r getting marry next month So also can i apply for adjustment of status as well? THanks

    • If 150 days have passed on the asylum clock and the clock is still running, you can apply for an EAD. You can check this by calling 1-800-898-7180 and entering your Alien number. Push “2” and it will tell you how many days are on the clock (it is a computer, you will not talk to a person). As for your fiancé, typically, the spouse needs to be a US citizen to help in a case like yours, but it depends on the case, and also, it might be possible to put your case “on hold” until she becomes a citizen. It would be very helpful to talk to a lawyer about that and to get a lawyer to help with the case to resolve it. Take care, Jason

    • You can apply for a travel document called Advance Parole (form I-131). However, if your case is in court and you leave, it could be considered a deportation and you might not get in, even with the travel document. Talk to a lawyer about your case before you try this. Take care, Jason

    • The form has the same number, but they made it longer. It is form I-765, available at http://www.uscis.gov. The instructions list the fee. Take care, Jason

    I am awaiting 4 my asylum interview, and EAD card since more then 5 months,
    my Q is that, my passport will expiry in coming September, and my wife and my son they are in my home country India, in case of any emergency, I have to travel out of state, but without passport I am not able to go any where, so can I able to Rene view my passport in emergency, it will effect my asylum case, more over its also difficult to get Rene viewed my passport as in my home country my status is shows over stay in USA?? please guide,

    • If your embassy lets you, you can renew the passport. Depending on your case, this could be a negative factor, or at least you will need to explain it. If you fear your home government, then certainly you will need to explain why you renewed the passport. In general, I have not seen this block people from winning a case, but you should be prepared to explain why you did it. Also, if you have a reason to expedite, you can ask to expedite your case (for example, based on family separation or a health issue). Take care, Jason

  44. Hello, I have just received my EAD card, we applied as a family of 4 but my husband’s was not amongst them, and he is the asylum applicant. How can I check what is going on. Secondly, can I apply for SSN and drivers license now?

      Congratulations on receiving EAD. May i know when did you apply for EAD as I am too awaiting our EAD will know at least how much time it takes. Also which center did you submit your EAD application.

        We submitted our application for EAD in March 1, 2017 and received them today March 28, 2017.
        We submitted through our lawyer and he said that they came in sooner than he expected.

    • Sometimes, some cards take longer than others, so as long as he received the receipt for the EAD, he should be fine. However, you can call USCIS to ask. Their number is on their website, http://www.uscis.gov. With your EAD, you should be able to get a DL and an SSN. Take care, Jason

  46. Dear Jason,

    I am trying to expedite our asylum case due to my child’s phsychological disorder. I just want to know the doctor’s note has to be in English with a stamp or it has to be translated into English from my native language with a notary stamp? Which is the right way? Also the supporting letters must only be signed with those people? And do we need to send the original documents through mail or should we send scans of those documents through email?

    • Anything not in English needs to be translated and you need to include the original, the translation, and a certificate of translation. Nothing needs to be stamped. When we include letters, we try to have them signed and to include a copy of the writer’s photo ID. Scanned copies are fine. As for submitting this to the asylum office, different offices have different policies, so you have to email them to ask whether they can accept an email request to expedite.     Thank u for the kind reply. Pls tell us from what date the 150 days to be counted for the work authorisation application. I m confuses whether it is to be counted from the date when USCIS recieved the I 589 by mail or when we received receipt from USCIS or the date when we appeared for fingerprints.

    I tried to check online status of the application but it didn’t reflect status and I also tried the toll free number but the automated answering machine replies that ours A no.did not match the records. But we have already appeared for the fingerprints 2 months ago.

    Pls help us to search for the clock time

    • On the receipt, it indicates the date that your application was received. Start counting from that date. You cannot check your asylum status on-line or by the phone number, but if you have the receipt and did your fingerprints, you are fine, and you can apply for the EAD 150 days from the date on the receipt.   48. Hello Jason, I wish to apply for an expedition of my file based on the following:

    My wife has a gallbladder that keeps on swelling and the doctor has tried to no avail
    my daughter has psychological problems and has developed a serious liver problem that makes her stomach swollen. The doctor will send me a letter from my home country as evidence.

    Can the above scenario help me to expedite my case if I apply?
    The life of my wife and daughter is in danger, I don’t know what to do.

    • You can get evidence of the problems, submit them to the asylum office, and ask to expedite. It may or may not work, but certainly you can try. Good luck, Jason
